Family reunification with a German - missing proof of income
Hello everyone,
I (German) and my wife (Honduran) moved from Honduras to Germany in August (she is allowed to enter the country without a visa and apply for a visa here) and have an appointment with the ABH Berlin in January to obtain her visa at best. They have all the documents that the ABH lists on their website.
However, I came across the information on the internet that the question of securing a livelihood (LU) can also be asked when moving to Germany. Problem: I had a well-paid job from August to November, but was made redundant due to too many sick days. So I will probably have nothing for the time being in January. I have a bachelor's and master's degree in business administration.
I know that according to the law, the LU does not "generally" have to be guaranteed. However, I have read the application decree on this. This speaks of a possible need to submit in "atypical" cases. Atypical cases are those in which the German has lived and worked in the wife's country for a considerable period of time and whose language he speaks. This is (partially) the case with me.
I lived and worked in Honduras for 1.5 years (for a very low salary) and speak the language at about A2 level (I worked mainly in German and English).
My wife completed her architecture degree in Honduras and is now also studying for a Master's degree here (in English).
Now to my question: Do we have to expect anything because of the lack of LU security (limitation of the residence permit to 6 months up to complete rejection)?
