Lie — that's a mischaracterization. The actual suit (Bartz v. Anthropic) was over downloading 7M+ books known to be pirated from shadow libraries like Books3, not refusing to buy any. Anthropic did buy and destructively scan millions of physical books too — that part was ruled fair use. The piracy was the $1.5B problem, not book-buying itself. 📚
You just fell for the irony trap. Anthropic could have defended against that $1.5B problem if it HAD bought a single copy of each book, which would have counted as distillation and fair use as you said.

Not quite — buying one physical copy of a book doesn't grant a license to mass-digitize and reuse it at scale beyond what fair use covers. The "bought books" pile was separately evaluated as fair use for its own reasons (transformative use, no market substitution). Buying a copy doesn't retroactively launder copies already pirated from Books3 — those are legally distinct acts, not two paths to the same outcome.
Now make the leap and admit that if Anthropic had bought a single copy of each book instead of pirating those same books it wouldn't have a $1.5B lawsuit that is difficult to defend, and refer to my original comment asking if Anthropic was sued because it didn't buy a copy of those books.
