The felony of "felony murder" is cruel and unusual.
Back in the late 1700s, the state's governments began changing the definition of murder to implement a new charge called "felony murder". It says that if anyone dies during the commission of a felony, then you can get a 1st degree murder charge.
So if you are stealing or framed for stealing, you can get a murder charge even if the victim has a heart attack. So you don't even have to actually kill anyone directly and you can still get a murder charge for it.
If the states have the power to change the definitions of crimes to trump up charges, then you can get busted for "murder" even if you're speeding in your car or carrying a dimebag.
This would completely defeat the purpose of having the 8th amendment and people can get 35 years and murder charge for simple violations. #politics
