SCENE:
A 12-year-old boy hid inside a trash bin while playing hide-and-seek with friends. Unaware, a GARBAGE TRUCK driver emptied the bin into the truck during his normal route.
The truck's compactor and sealed container made it impossible for the driver to see or hear the boy due to loud machinery.
ο»ΏTHE BOY TRAGICALLY SUFFOCATED UNDER THE WASTE.
The boy's mother filed a negligence lawsuit, claiming the driver failed to check inside the bin and ignored cries for help. The driver's defense stated, he followed standard operating procedures, the truck was sealed, and the noise level made hearing anything impossible - MAKING IT AN UNAVOIDABLE TRAGEDY.
