" ο»Ώ Community Discussion : Ethics & Responsibility"

SCENE:
A 12-year-old boy hid inside a trash bin while playing hide-and-seek with friends. Unaware, a GARBAGE TRUCK driver emptied the bin into the truck during his normal route.

The truck's compactor and sealed container made it impossible for the driver to see or hear the boy due to loud machinery.

ο»ΏTHE BOY TRAGICALLY SUFFOCATED UNDER THE WASTE.

The boy's mother filed a negligence lawsuit, claiming the driver failed to check inside the bin and ignored cries for help. The driver's defense stated, he followed standard operating procedures, the truck was sealed, and the noise level made hearing anything impossible - MAKING IT AN UNAVOIDABLE TRAGEDY.

When there is negligence it is always the two parties who are always involved. In this case, the mother or the nearest kin who failed to supervise the child that caused negligence for the child to hide in the trash bin and the one who did not take extra diligence in taking the trash bin. Wheras said accident is not done with intention but neither evil caused is lack of foresight to both parties. Therefore either the relatives nor the truck operator can be held responsible for having a participatory negligence that causes the child suffocation by accident.

In my opinion, it's the garbage collector man will be held liable. After stopping, he should check first the garbage bin before loading it to the truck. It's a safety first precaution to check first what's inside the bin you're about to load. You don't know if somebody put inside prohibited materials or like the situation, there is a boy inside.

In my opinion, the responsibility should be shared. The boy made a very risky choice by hiding inside the bin, but the driver also had a responsibility to make sure the bin was safe before emptying it. At the same time, if the driver really followed the normal safety procedure and could not see or hear the boy, then I think it was a tragic accident rather than something done intentionally.

The first question is why a 12 year old kid would think to hide in a trash bin, knowing that the garbage truck will come to collect it at any moment. On the other hand, the garbage truck driver cannot be blamed either because as what he said he followed the proper procedure in collecting the garbage .
A clear lesson to this scenario is that trash bins should not be used as hiding places while garbage truck drivers should make it a habit of checking the garbage bins before loading onto the truck.

It is a sad and unfortunate situation, but I see several parties who bear responsibility:

1.- The child, for playing in an inappropriate and dangerous place.

2.- The child's friends; in a game of hide-and-seek, one person counts and searches while the others hideβ€”one of the friends who wasn't inside the dumpster could have warned the driver.

3.- The mother, for not keeping an eye on her child.

4.- The truck driver; while his actions may have been within standard operating procedures, upon seeing children running nearby during his route, he could have gotten out to take a look.

I think the fault lies with the garbage man who did not inspect the trash can and placed it on a garbage truck that dumped the contents of the trash can into the compacting machine in the cargo area. There might be something alive in the bin and the garbage man needs to check it. If the garbage man doesn't know it, then the management of the garbage company should train all the garbage men to check the contents of the garbage cans to see if there is anything alive.

For me, this is an "unavoidable tragedy" where no one is truly at fault, but everyone shares some responsibility.

I can't put 100% of the blame on the driver. He was just doing his job based on the standard operating procedure. Garbage trucks are naturally loud and have a sealed design for the driver's safety and to prevent trash from spilling. If we expect him to check every bin before emptying it, it would not only take too long, but he would also be put at risk because of the dirt, broken glass, and chemicals inside the trash. He had no intention to hurt anyone.

On the other hand, we can't put all the blame on the 12 year-old boy either. He is still a child. In his mind, he was just playing hide and seek and wanted to win the game. He didn't fully realize that the trash bin he thought was a good hiding spot could actually cause his death.

So for me, the one who should really be held accountable is the system itself.

It is the responsibility of the city and the garbage company to create a safer system for example, a trash bin with holes in the lid so someone can breathe and be seen inside, or by having a camera and sensor on the truck. It is also our responsibility as parents and adults to constantly remind children that trash bins, streets, and other dangerous places are not toys.

What happened is very sad. No one wanted this. So instead of looking for someone to put in jail, it's better to make this a lesson so it will never happen again to another child.

Well, first of all I would like to say GARBAGE TRUCK driver should be more alert when checking trash container though I can't blame him saying irresponsible when the noise made him unheard the cry of the boy. Next I would like to say, parents should teach kids what is good and what is not, trash container isn’t a good place to hide because it contain different kinds of virus and bacteria and kids learn from parents and family. So before blaming other's better they teach kids about good and bad things around them. As the boy was a minor (not 18+) so I can't blame him for his suffering, can't even blame that GARBAGE TRUCK driver, so I think parenting should be better for kids and their actions will represent that they are under good parenting. That's a personal perspective!

From my perspective, I would not place the entire blame on the garbage truck driver. However, I also would not say that the situation should simply be dismissed as an unavoidable accident without looking at the responsibilities of everyone involved.

The driver was performing his regular duties, and he apparently had no knowledge that a child was inside the trash bin. If the truck was sealed, the machinery was extremely loud, and the driver followed the established procedure, then it would be difficult to argue that he knowingly ignored a child in danger.

At the same time, I believe situations like this should make us question whether the safety procedures themselves are enough. If there is a possibility that a person could accidentally or intentionally hide inside a garbage container, there should be reasonable precautions to prevent something like this from happening again.

I also think the child's decision to hide inside a trash bin was an important factor. A 12 year old may not fully understand how dangerous that situation could become. This is why children need proper guidance about where it is safe to play and what places should never be used as hiding spots.

The parents' role can also be considered, but I would be careful about blaming them without knowing the full circumstances. We do not know whether the parents knew where the child was, whether they were nearby, or whether the child acted without telling anyone.

For me, the most important point is that responsibility should be based on what each person could reasonably have known and done at the time not simply on who happened to be involved in the accident.

The child's death was a heartbreaking tragedy, but blaming one person immediately may not solve the real problem. Instead, the incident should be used to determine whether there were failures in supervision, safety procedures, or communication that could have prevented it.

In the end, I would say that this is a situation where responsibility needs to be carefully examined rather than automatically placed on the driver. Sometimes a tragedy can happen without one individual intentionally doing something wrong, and the goal should be to understand what happened and prevent another family from experiencing the same loss.

This is such a sad story to hear. I really doesn't want to blame the parents, nor the driver for this. A 12 y/0 kid is already considered a ypung adult. He can do the thinking that an adult ones can do. They are basically the new generations who are capable to rule the world. So, I must say it is the boy who should be blamed for ending his life so soon. The mother is just taking the blame to the driver since she should be one protecting and caring for her child...that she should have taught her kid a better game..
Imagine in a cases like killings by juvenile offenders, they know what they are doing, it has been an excuse for them not to be imprisoned. They are brave enough for they the law protects them.
But well, this is such a sad story if this really happens.what do you think, ?

No one is to blame. The waste truck driver is not required to look inside every container.
The parent cannot be held responsible either, as the boy was already 12 years old and climbed into the bin of his own accord.
Due to the loud noise, the driver genuinely could not have heard his crying or shouting.
It was a tragic accident; the boy was simply in the wrong place at the wrong time.
If the mother presses charges against the driver, I believe the court will acquit him, as he is not at fault and made no errors in the course of his work.

I think the main responsibility should be shared. The boy made a dangerous choice by hiding in the trash bin, while the adults should also make sure safety rules are followed. It was a tragic accident, and I think the focus should be on learning from it and preventing something like this from happening again.
