👇 Read the SCENE
A woman was accused of kidnapping after taking children from a neighboring house during a fire. In court, the woman stated: I saw a lot of smoke coming out of the kitchen window. The children were home alone and were screaming for help from the upper floor. I just wanted to save them.

However the prosecution argued that the defendant had entered private property without authorization and removed the minors without their parent's consent. According to State Law 18304 - this constitutes interference with custody. The prosecution emphasized that the defendant should have waited for the firefighters or the police to arrive instead of acting on her own.

However, there was video footage of the house fire as well as footage showing the children being rescued. The fire department confirmed that the fire started in the kitchen and spread rapidly. If they had waited just a few more minutes, the flames could have reached the second floor bedrooms.

The woman without the parents present rescued the children from the fire, preventing a fatal tragedy.

I am I would rule it an act of heroism, not kidnapping. The woman acted during an immediate life-threatening fire to save children who were alone and in danger. In an emergency, protecting lives should take priority over waiting for permission when every second matters. ❤️🔥

I am and If I were the judge, I would say the woman is not guilty of kidnapping. She entered the house because the children were in danger and needed help immediately. She did not take them for herself or try to keep them away from their parents.

The fire was spreading quickly, and waiting for firefighters could have put the children’s lives at risk. She made a quick decision to get them out safely. In my opinion, she should be praised for helping the children instead of being punished. I would consider her actions an act of courage and kindness, not kidnapping.

Straight to the point, if I were judge I definitely find this ACT OF HEROISM not a kidnapping case. As firefighters stated that, fire could reach second floor bedroom in few minutes and that minor could be affected by the flame of fire so if he was rescued earlier, his life was saved and she deserves to be rewarded not punishment. If the savior get punishment in this case, people will stop helping each other and humanity could be lost from our world or society. That's all I want to say and I understand after reading the whole incident.

An act of kidnapping is an act where there is taking against the will of the victim by using force, threat, or intimidation necessary to execute a criminal intent.

However in the present case,
there is a necessity to help the kids due to fire and to keep your neighbors safety in times of danger is not kidnapping at all. Also interference is only applicable when there is a breach or security encroachment issues based on a contract.

Likewise, in the Philippines there is an specific case for “abandonment of help “ where in you will be more guilty as offenders if you don’t save someone in front of you who is in the amidst of danger between life and death.

Therefore, in case of doubt the good deeds must have interpreted as done with good intentions and can be treated as an “act of heroism “

If I were the Judge, I would find the woman NOT GUILTY of kidnapping.
