Topic : Under the Philippine law, a Senate impeachment trial must observe the concurrence of two/third votes from twenty four senators.
Our Vice-President Sarah Duterte-Carpio is now being hold on trial allegedly for violation of graft and corruption charges.
Now, the Senate-Impeachment Trial Court has moved to clarify the two/third votes since the 24 senator is no longer completely 24. One of it was allegedly fugitive and couldn’t longer locate its whereabouts due to his warrant of arrest provided by the International Criminal Court for allegedly violation of International crimes, while the other two senators was in jail facing graft and corruption charges. From that scenario the Senator Judge has invited a three retired Supreme Court Justice and we called it in legal luminaries as “ amicus curae “ which means friends of the Court who can able to testify and provide a close clarification of what is two thirds vote, and two of them agreed that the two/third votes in a logical explanation is 16/24 but the other one dis agree and says “since three (3) Senators were no longer physically available then the two thirds votes not to exclude the other one (1) Senator Judge should be treated that the Senators present all in all is 20 therefore the two/third votes should be 14 since two third of 20 is 14.
Question;
1. If you were to ask to make a clarification of two thirds votes from 24 senators what is two third votes for you ?
2. Does the contention that since four Senators can no longer vote, then the 24 will become 20 immediately and the result of the vote must be reduce automatically from 16 to 14 votes is proper yes or no ? Explain your answer..

The two-thirds is the important part really, not the number of senators (in my opinion). 24 with 3 gone still leaves a number divisible by 3.
Or let the two in jail vote, discard the vote from the fugitive, and stick with 16 as two-thirds.
But that is logical thinking and we know politicians are anything but logical.

Yes for fairness we have to follow the rules the 24 should be interpreted as 24, and the two thirds of it is 16, since the Constitution did not make any exception as to whether or not a senator when in jail can no longer allowed to vote same stand with the two former Chief Supreme Court Justices manifestations, thanks 🙏
